TVS Cease and Desist

TVS are not going to run out of cash. Money talks (JJ Cale)

From “8“ or the live performance?
Wish he was still around, one of my all time favorites.

I did some research on TVS.
No, capitalization does not appear a problem. Considering the way they are structured and long term growth I gotta’ wonder why the Norton purchase?
Develop and promote or secure it to nullify competition?

Well I am happy someone is carrying on making the bikes (I think). I doubt the younger generation will buy any of them. They are more likely to buy a Triumph, Enfield, Ducati etc. It’s going to be interesting to see how it goes. I hope they don’t mess with Andover Norton, our friends.

I have been listening to JJ all my life on vinyl and now Spotify. My go to artist of all time.

Looks like Harleyman has gone and they have a CEO & CTO with some decent motorcycle experience coming in. Here is a message for the new men in the seat - build a bloody bike and it better be a Norton. You can build the fastest most reliable best looking bike in the world, but it must have that Norton charm, which is the hardest part to design.

Speaking of charm, or style, or panache, look at the new RE Interceptor. What bike does it remind you of?
The original Series 2 from 1969? Sure the Styling Cues are there but really it looks like what a motorbike is supposed
to look like. And the Norton (current) has that look too. So many of the retro bikes look silly just as the
Triumph looks over fed and a bit too much like a late 50's automobile.
So the looks, of both bikes must be aimed at us it seems, not the crotch rocket set. Must be a market for good taste!

Second guessing future market trends is one thing, doing that and making a Norton is another. They have their work cut out before they even sharpen a pencil, and to alienate tens of thousands of potential customers has not helped, maybe the new German CEO (not Sir Ralphy) and Italian CTO will see the light and apologise for this mess their predecessor has left them.

The market isn't a bunch of 60-80 year old marque fanatics. Most of us won't be buying a new Norton branded
motorcycle made in India. The market is 20-40 year olds who are oblivious about the history of the marque, and
the future market won't be USA, Australia and USA. It will be India, Indonesia, Brazil, Nigeria and China.

If that's the case, What's the purpose of purchasing and using the name in the first place?

There is a website on my servers that had their logo on. Since I host it I received this letter asking me to shut down the website.
They are not messing about. I had to remove the logo on the afore mentioned Norton Club Website.

TVS Cease and Desist

The new owners certainly know how to destroy a potential customer base, maybe we are not worthy. What with the V4 faults which look like they will not be fixed or warranteed by the new owners, not even any goodwill, looks like they are the ones dragging the name down the toilet.
Hopefully Dr Robert will talk to the right people, not idiots like gullible harleyman has in the past, and a better understanding of the Norton world will stop these brand destroying attacks.

Defend our rights as a group of mature enthusiast's interested in the same horizonal twin motorcycle. Start a class action suit that they are infringing on our rights to freedom of speech. If money is needed I will be the fist to donate!!

Just heard, ammunition being delivered to Solihull by the pallet load, they like the feeling of shooting themselves in the foot / arse / etc.

Free legal advice is worth what you pay for it, but I would hate to defend NMCL's trademark if the defense relied upon proving the truth of the factual statement: "Due to the excellent quality of NMCL's goods . . . ." The acres of posts about Stuart Garner's products and TVS' own publicity about problems with the V4 would seem to make that a bit of a challenge. Some junior associate copied and pasted the contents of your letter from his firm's form library. I know less than nothing about trademark law, but I suspect that NMCL's rights to the trademark are protected so long as they give you permission to use it. Sort of like adverse possession of property. If I openly move my border fence on to my neighbor's property, and he does nothing about it, after some period of time I may gain legal title to the land on my side of the fence. But if my neighbor sends me a letter saying it's ok for me to move the fence, all I have is a moved fence and I never get title. So probably worth contacting NMCL and asking for permission.

The letter is only demanding that the trademark logo is not used without permsion.

As stated above, maybe that permission will be granted if asked for ?

Ok, yeah, I doubt it too! But, for perspective, the best Norton website on the planet seems to do well without ever having used Nortons trademark logo...

On reflection this smacks of taking away our freedom of speech....why, just think, the last mob who were making Nortons did such a bad job and became slagged off both in the press and social media, that it became an embarrassment to the new boys on the block.
They can not correct all the faults of these 2020/21 bike without incurring considerable expense, so they've got their heads together to see how they can shut down these reports, of which none of it is their own fault, so, shut them down.
They will then become free to setup their own website business, praising their own bike models, free from interference, whilst possibly ignoring the earlier models that ended up bankruping the previous company.
The cat's out of the bag on their intentions . . .

I think you’re miles off there. How does not being able to use someone’s registered trademark logo effect your freedom of speech, really ?
