Justice?

Whats the legal time limit for you to claim compensation from the other party for this "accident "?

I reckon I can come pretty close to sympathising with you. Coming up to a year since my acident and I've more surgery to go. I was offered the right to have my "offender" attend court or to just have him charged by the common letter of the law. The latter was for "failing to give way" only. I was in a pretty horrible headspace when the police gave me this choice: bunged up in hospital with half my bones busted and totally zonked on opiate pain-relief. I elected to have it proceed under the common right of law only, which was as a traffic offence. I found pity for an 83yo guy who had lost his wife a week before to cancer. Sure he lost his license and will never drive again. I have since found that I cannot forgive him as I have not received any apology from him. That might mark me down as petty, but the simple act of an apology would change my whole thinking about the matter and help me move on. It's been a shit year, but I've got to put it behind me before it wrecks the rest of my life.

I'm really sorry to hear this Yves, but not very surprised I'm afraid. A colleague of mine (also Belgian) had his mother crippled for life in a car crash, also caused by the other person disregarding the posted signs. Very much the same result, a (relatively) small fine and not much else. The situation here in Denmark is not very much different either I think.
Best wishes to you and I really hope that things get better. How are you progressing by the way? Been some time since we have heard any updates I hope that is a good sign though...

Hi Steve,
My healt situation don't get better, I can walk 100 meters maximum and I can ride my Seeley but not more as one hour, with very low footrest.
I still need someone to help to put my leg over the bike
I work every day 3 hours in the workshop, with a chair on bot sides from my hydrolic workbench.
I am still very happy to be here and to find hapyness in the small things I have left.

Yves, I know it’s easy for me to say, and that I may feel very different if I was in your shoes, but...

For what it’s worth, my advice is to try and put the other driver out of you mind. As difficult as it is to be magnanimous in a situation like this, the bottom line is that she did not do this intentionally. And for your own good, you would be much better off focusing on your own health, your own recovery, and putting all of your spare energy into pursuing your rightful financial compensation.

Yves... I would not assume that her insurers will assume that their client was 100% to blame. Do try and work everything back from the point of impact ,how far would she have to travel , how long for instance would it have taken her to reach it ? And ,however many seconds that might be .,how far away does that place your bike? Curiously most legal professionals do nor seem to be able to manage the elementary physics and mechanics of such calculations and it may enable you to wrong foot any whoppers the car driver may tell.
